Judge denies FSU’s motion to dismiss Title IX lawsuit by Winston accuser
Florida State University’s motion to dismiss the lawsuit brought against the school by the woman who accused ex-Seminoles quarterback Jameis Winston of raping her was denied Wednesday by a federal judge, according to USA Today.
The woman filed a lawsuit against the school in January alleging that the university violated her Title IX rights by failing to properly investigate her claims against Winston.
The woman alleges that Winston raped her in December 2012. Winston never faced criminal charges in the case after an investigation by Tallahassee police that was fraught with controversy. A report by Fox Sports in October 2014 found that TPD and FSU officials “took steps to both hide, and then hinder” the investigation into the woman’s accusation. The New York Times also outlined the flaws of the investigation in an April 2014 report.
Winston had a two-day hearing in December 2014 to determine whether he had violated the school’s Code of Conduct and was cleared.
The Title IX case is scheduled to go to trial in July 2016.
