Hayes’s attorney, John Fuller, told reporters that his client collided with Smith’s SUV while following a hit-and-run driver but did not identify Smith as the driver.

Smith’s wife Racquel was also injured in the shooting. She was hospitalized with two gunshot wounds to her leg.

Smith, 34, last played for the Saints in 2012.
