Former Pro Football Hall of Fame running back and Heisman Trophy winner O.J. Simpson may be released from prison in lieu of a new trial.

A Nevada judge scheduled a November hearing to determine if Simpson was poorly represented by his trial attorney, Yale Galanter, before being found guilty of armed robbery and kidnapping in 2008.

Simpson claims Galanter's business dealings created a conflict of interest.

The hearing could reopen the 2008 trial in which Simpson was accused of leading two armed men and three accomplices into a confrontation with two sports memorabilia dealers and an associate in a Las Vegas hotel room. The 65-year-old Simpson seeks release from state prison, where he is serving nine to 33 years.

Simpson's appeals attorney Patricia Palm said Simpson wants a chance to show that Galanter was in Las Vegas and knew in advance about Simpson's plan to retrieve items from the memorabilia dealers that Simpson claimed were stolen from him after his 1995 acquittal in the Los Angeles slayings of his ex-wife, Nicole Brown Simpson, and her friend, Ronald Goldman.

Galanter, a Miami lawyer who represented Simpson in other cases before the arrest in Las Vegas, denied during trial that he had anything to do with the ill-fated Las Vegas caper.

The development could put Simpson on the witness stand for the first time since losing a 1997 civil suit filed by the Goldman and Brown families.
