Report: Avery preparing to file libel suit against Toronto reporter

According to a report in the N.Y. Post, Sean Avery is preparing to file a libel charge against a Toronto radio personality who suggested Saturday’s pre-game skirmish was incited by Avery commenting on Jason Blake’s health condition.

As advised by his attorney, Avery has privately denied the charge reported by Howard Berger of the Fan 590, who cited an unnamed Rangers player as the original source.

Avery engaged in fisticuffs with Darcy Tucker in the first period of Saturday’s game, but it seemed to be no more than two agitators trying to win momentum for their teams.

Toronto coach Paul Maurice said after the game that he had no problem with Avery’s antics.

The report also says Avery has been summoned by the NHL for a Tuesday hearing with executive V.P. Colin Campbell, but a suspension is not expected.
