Man misidentified by Browns for throwing beer sues

The man who was mistakenly identified by the Browns as the fan who threw beer on a Titans player is suing the team, per ESPN.

In a lawsuit filed Tuesday morning in Cuyahoga County, Eric Smith, 35, said he did not attend the Browns’ season-opening loss to Tennessee, where a fan threw beer at the Titans’ Logan Ryan. Smith, who was at home with his family and was preparing to DJ a wedding that same day, was banned from the stadium following his misidentification.

The Browns apologized to Smith privately and issued a statement later in the week saying they had "not explicitly identified the individual involved or taken any formal action of punishment."

According to his attorney, Smith is seeking a public retraction from the team, in addition to financial damages.

A spokesman for the Browns declined to comment to ESPN on Tuesday, citing the pending litigation.
