Seattle Seahawks Ex Marshawn Lynch Argues Against DUI Charge

Marshawn Lynch’s lawyers, however, have argued that his situation does not constitute a DUI.

Seattle Seahawks ex Marshawn Lynch was last August arrested after a traffic stop in Las Vegas. He's facing multiple charges, which includes suspicion of DUI - but his attorneys are arguing against the allegations.

This week, the 8 News Now Investigators obtained documents regarding Lynch's arrest. 

Prosecutors suspect that Lynch had a blood alcohol level at more than twice the legal limit hours after the police found him sleeping in his car. Allegedly, his blood alcohol level was 0.18. 

Even though Lynch was found asleep in the vehicle, Nevada law states a person in the driver's set of a vehicle is "in physical control." 

Lynch’s lawyers, however, have argued that his situation does not constitute a DUI.

Lynch attorneys David Chesnoff and Richard Schonfeld contend that there is no evidence that he drove the vehicle anywhere near the area’s Las Vegas Strip. 

“While (law enforcement) claims to have ‘observed a strong odor of an alcoholic beverage emitting from the vehicle, his person, and his breath,’ no evidence proves that Mr. Lynch drank anything or actually operated the vehicle on the night of the encounter,” documents said, via 8 News Now.
