Report: Former Alabama Basketball Player Darius Miles Denied Immunity in Capital Murder Case

There is another update in the capital murder case in the death of Jamea Harris regarding former Alabama basketball player Darius Miles.

As first reported by The Tuscaloosa News, Miles was denied a motion to dismiss the capital murder charge by Tuscaloosa County Circuit Judge Daniel Pruet on Thursday.

Miles' defense team argued during a pre-trial immunity hearing that he was acting in self-defense and should be immune from the murder charges. Miles brought the gun to his friend Michael Davis, who fired the shot that killed Harris.

The judge wrote in the ruling that the defense failed to establish that Miles was actually fearful for his safety with the self defense argument. 

"The defendant failed to establish that he reasonably believed that anyone inside the Jeep was using or about to use deadly physical force or that they were committing or about to commit Assault in the 1st Degree or Assault in the 2nd Degree," Pruet wrote in the report according to the Tuscaloosa News. "Accordingly, the Defendant's Motion is Denied."

After being denied immunity, the next step for Miles will either be a plea agreement or trial. Miles has pled not guilty.
