New indictment against coach in ex-girlfriend's son's death

CANTON, N.Y. (AP) A new murder indictment has been issued against a former college soccer coach accused of strangling and smothering his ex-girlfriend's 12-year-old son in New York.

The indictment says Oral ''Nick'' Hillary killed Garrett Phillips in October 2011 inside the boy's home in Potsdam.

The first indictment came last May but was later dismissed by a county judge who criticized the district attorney for what he described as bullying and prejudicial questions of grand jury witnesses.

St. Lawrence County District Attorney Mary Rain says the same evidence was presented again to a grand jury last week.

Hillary is a former coach at Clarkson University in Potsdam.

His lawyer says Hillary continues to maintain his innocence and that there are two alibi witnesses who will testify he wasn't at the boy's home at the time of his death.
