Andrew Rector, who fell asleep during a Boston Red Sox vs. New York Yankees game on April 13 and was shown on national television, is suing ESPN and MLB for $10 million for defamation.
Rector, 26, is suing after ESPN announcers Dan Shulman and John Kruk made light of the situation on air. Rector's lawsuit cites the comments by the broadcasters and MLB's distribution of the video as part of an "unending verbal crusade." The Smoking Gun posted the lawsuit, which includes Rector's main argument:
"Announcers like Dan Shulman and John Kruck [sic] unleashed avalanche of disparaging words against the person of and concerning the plaintiff. These words, include but not limited to 'stupor, fatty, unintelligent, stupid' knowing and intending the same to be heard and listened to by millions of people all over the world."
Rector's case also points to the slew of online comments made by other fans.
