A 19-year-old accusing Cavaliers guard J.R. Smith of assault is asking a judge to move forward with his case, reportsThe New York Daily News.

Last fall, Justin Brown accused Smith of choking and manhandling him after refusing to take a photo. Smith was never criminally charged in the incident.

Brown’s lawyers recently filed court papers asking for a default judgment in the case in Manhattan Supreme Court on the grounds Smith’s lawyers never responded to Brown’s original claim. Brown had filed a $2.5 million lawsuit against Smith after the alleged incident.

Smith has denied ever choking Brown. The Cavaliers guard is currently playing in the NBA Finals.
