New England Patriots quarterback Tom Brady can play Week 1 after federal judge Richard Berman overturned his four-game Deflategate suspension in announcement on Thursday.

The NFL says it will appeal the decision but will not seek a stay of the order. Thursday’s developments mark the biggest news in the Deflategate saga since Brady was initially suspended on May 11.

NFL commissioner Roger Goodell upheld the suspension on July 28, and since then, both Brady and the league filed lawsuits in federal court. Judge Berman pushed the sides to consider a settlement, but that had not happened by Monday; the league never made Brady a formal settlement offer, the New York Daily News reported.
