Former Yale basketball captain Jack Montague has sued the school over his expulsion for a sexual misconduct accusation.

Former Yale basektball captain Jack Montague has filed a civil lawsuit against the school over his expulsion for a sexual misconduct allegation, the Associated Press reports.

Montague was expelled in February after a school panel found him culpable of sexual assault. Montague was accused of rape by a woman after an alleged incident that occurred in October 2014.

Montague’s lawyer said in March his client would sue the school over his expulsion. The lawsuit claims Yale made Montague the school’s “poster boy for tough enforcement” of sexual misconduct policies. The lawsuit echoes the claims of Montague’s lawyer from March, when he said his client was being used as a “whipping boy” for a campus-wide issue of sexual assault.

The lawsuit also alleges that Montague’s accuser did not want him punished, only counseled, but was pressured by Yale into filing a formal complaint. The suit also makes a Title IX complaint, claiming that Montague was a victim of gender inequality.

 Montague is seeking damages and readmission to the school.

“Yale's procedures for addressing allegations of sexual misconduct are thorough and fair,” school spokesman Tom Conroy told the AP. “Allegations are investigated by an impartial fact-finder, heard by five trained members of the Yale community, and decided by the accused student's dean.”
